1. Introduction and Acceptance

Welcome to SwipeLit ("the App," "we," "our," or "us"). By downloading, installing, or using SwipeLit, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

SwipeLit is a freeware mobile application available on the iOS App Store, created and operated by Bama Morgan, located in Okaloosa County, Florida, United States.

2. Description of Service

SwipeLit is a free book discovery application that allows users to browse book covers sourced from Open Library and The New York Times Best Sellers lists. Users can swipe through books and organize them into personal libraries stored locally on their device.

The App is provided free of charge ("Freeware") and will remain free forever. There are no premium features, subscriptions, or in-app purchases.

3. Local Data Storage and Privacy

No Backend or Cloud Storage: SwipeLit does not connect to any backend servers, databases, or cloud storage systems for user data. The App operates entirely offline with respect to your personal data.

Device-Only Storage: All user data, including your Like Library, Read Library, preferences, and any other personal information, is stored exclusively on your device's local storage. This data never leaves your device and is not transmitted to us or any third party.

Full User Control: You have complete control over your data at all times. You may delete the App and all associated data at any time by uninstalling SwipeLit from your device. Upon uninstallation, all locally stored data will be permanently deleted.

No Account Required: SwipeLit does not require user registration, account creation, or any personal information to function. Your libraries and preferences are anonymous and tied solely to your device.

4. Third-Party Services and Content

SwipeLit retrieves book information, including covers, titles, authors, and metadata, from the following third-party sources:

  • Open Library: An open, editable library catalog. Book data is provided under their terms of use.
  • The New York Times: Best Sellers list data is provided by The New York Times API.

We do not control the content provided by these third-party services and are not responsible for the accuracy, completeness, or availability of such content.

5. Amazon Associates Program Disclosure

Affiliate Disclosure: SwipeLit is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites and applications to earn advertising fees by advertising and linking to Amazon.com.

Qualifying Purchases: When you tap on a book to view details and subsequently click on the "Buy on Amazon" or similar Amazon price check links within the App, you will be directed to Amazon.com. If you make a qualifying purchase through these links, SwipeLit may earn a small commission at no additional cost to you.

No Obligation: You are under no obligation to purchase any products through our Amazon affiliate links. The inclusion of these links is solely for your convenience and to help support the continued development and maintenance of this free application.

Amazon Trademarks: Amazon, the Amazon logo, and all related marks are trademarks of Amazon.com, Inc. or its affiliates. SwipeLit is not endorsed by, directly affiliated with, maintained, authorized, or sponsored by Amazon.

6. Intellectual Property

The SwipeLit name, logo, and all original content, features, and functionality of the App are owned by the creator and are protected by international copyright, trademark, and other intellectual property laws.

Book covers, titles, author names, and other bibliographic data displayed in the App are the property of their respective owners and are used under fair use principles or through authorized APIs.

7. User Conduct

By using SwipeLit, you agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to any portion of the App
  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Reproduce, distribute, or create derivative works based on the App without express written permission
  • Use automated systems or software to extract data from the App

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the App will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWIPELIT, ITS CREATOR, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (c) ANY CONTENT OBTAINED FROM THE APP; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless SwipeLit, its creator, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Okaloosa County, Florida, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect through an update to the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

13. Termination

You may terminate your use of the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

  • Is completely under your control
  • Is deleted when you uninstall the App

No Backend Infrastructure

SwipeLit operates without any backend servers, databases, or cloud infrastructure for user data. We do not maintain user accounts, profiles, or any form of user database. The App functions entirely on your device.

Third-Party API Connections

The App connects to third-party APIs (Open Library, New York Times, Amazon) solely to retrieve book information such as covers, titles, authors, and pricing. These connections:

  • Do not transmit any of your personal data
  • Do not share your library contents or preferences
  • Are used only to fetch publicly available book information

Data Portability and Deletion

You may export and share your library lists using the built-in sharing features. To delete all your data, simply uninstall the App from your device. Since no data is stored externally, uninstallation results in complete and permanent deletion of all your SwipeLit data.

Children's Privacy

SwipeLit does not knowingly collect any information from anyone, including children under 13 years of age. Since we do not collect any personal information, there is no data collection from minors.

Changes to Privacy Policy

We may update this Privacy Policy from time to time. Any changes will be reflected in the "Last Updated" date at the top of this page. We encourage you to review this Privacy Policy periodically.
